Can’t rely only on State to determine truth, citizens must be more vigilant: Justice Chandrachud

Supreme Court judge Justice D Y Chandrachud, while speaking at a virtual event Saturday, said totalitarian governments are associated with a “constant reliance on falsehoods” and it is the duty of citizens to strengthen public institutions and always question the State to determine the truth.

While delivering a talk on the topic “Speaking Truth to Power: Citizens and the Law” as a part of the 6th MC Chagla Memorial Online Lecture, Justice Chandrachud said speaking truth to power is a right that every citizen must have in a democracy but equally, it is a duty of every citizen, the Live Law reported.

The right to speak truth to power by the citizens is integral to the functioning of a modern democracy, he said, adding, one cannot rely solely on the State to determine the truth but citizens must remain more vigilant and participate more actively in the process.

India suffered an innings and 76 run loss against England after being bowled out for 278 in their second innings in the third cricket Test here on Saturday.

England thus levelled the five-match series 1-1.

Resuming at an overnight score of 215 for 2, India's second innings folded in 99.3 overs with England pacer Ollie Robinson claiming five wickets.

India were bundled out for a paltry 78 in their first innings on the opening day.

England then posted 432 in their first innings to take a mammoth lead of 354 runs.

India had beaten England by 151 runs in the second Test at Lord's.

Situation turned tense in Karnal after police resorted to lathicharge in order to disperse protesting farmers from Bastara toll plaza Saturday morning. Later in the day, union leaders asked more farmers to join the protests and block the national highway, resulting in blockades at Bastara toll plaza and another toll plaza on the national highway in Shahbad (Kurukshetra). Protestors also blocked the Kalka-Zirakpur highway (Surajpur toll plaza).

The Commissionerate of Police (Panchkula) tweeted, “It is informed that Surajpur Toll Plaza (KAlka-Zirakpur highway) has been blocked by protesting farmers. The traffic on this route is being diverted. All commuters are advised to avoid this route except in extreme emergency.”

In the morning, the protesters had blocked the national highway against a meeting on the upcoming municipal polls chaired by Chief Minister Manohar Lal Khattar Saturday afternoon.

Several farmers sustained injuries as the police used force to disperse the gathering.

Following the lathicharge, Bharatiya Kisan Union (BKU) leader Gurnam Singh Chadhuni appealed to the farmers from across the state to reach Bastara and other toll plazas in large numbers. “I appeal to all my brethren to immediately reach the toll plazas near their location. If toll plazas are far from your location, block the nearby highways,” Chadhuni said in a video message.

Later, a viral video, purportedly showing 2018 batch IAS officer Ayush Sinha instructing the force to “pick up each protester and hit them on their back” surfaced on social media platforms.

Sinha, appointed as the duty magistrate in Karnal, is heard saying in the video, “Utha Utha ke maarne peeche sabko (pick up each protester and hit them on their back)”

He adds, “We shall not allow this cordon to be breached. We have enough force available. We haven’t slept for in the last two days. But you guys have come here after taking some sleep, I am sure. Mere pas ek bhi banda nikal ke nahi aana chahiye. Agar aaye toh sar foota hua hona chahiye uska. Clear hai aapko? (Not a single protester should be able to reach till me and even if someone manages, his head should be broken. Is it clear?)”

The protest began when BJP was holding a meeting to formulate the party’s strategy for the upcoming municipal polls. Several senior Haryana BJP leaders were present in the meeting. The farmers attempted to gather outside Prem Plaza Hotel in Karnal where the meeting was on but when they could not reach there, they blocked the national highway at Bastara toll plaza.

The protestors showed black flags to BJP leaders and even tried to stop their vehicles from moving ahead. However, due to heavy police presence, the farmers could not block any vehicles but kept shouting anti-BJP slogans.

Karnataka Home Minister Araga Jnanendra on Thursday kicked up a row over his rape comments made in the context of a gangrape incident in Mysuru, that did not go down well with Chief Minister Basavaraj Bommai and opposition Congress, prompting him to withdraw his controversial statement.

The Home Minister's remarks that the gangrape victim and her male friend should not have gone to the deserted place and his claims that the opposition Congress was trying to 'rape' him by targetting him, following the incident, evoked sharp reactions from the opposition party, even as Jnanendra accused it of trying to derive political mileage from the 'inhuman' incident.

Hitting out at the Home Minister and the ruling BJP, the Congress said they are "incapable" of protecting the people of the state.  With the issue snowballing into a major controversy and the Chief Minister also disapproving of his comments, Jnanendra withdrew his statement.

Meanwhile, the Chief Minister said his Government will form a special team to investigate the gang-rape case and asserted that the perpetrators will be caught soon and brought to justice.    

Bommai also disapproved of the comments made by Jnanendra and said, "I just don't agree with the comments made by my Home Minister regarding the gang-rape incident.  I have advised him to give a clarification.""I have directed the officials to pursue the matter seriously and update me on the developments," he added.

The Chhattisgarh High Court Thursday discharged a man from facing trial for allegedly raping his wife, given that Indian law does not recognise marital rape if the wife is above 15 years of age.

The High Court was hearing a criminal revision plea by the husband against the framing of charges based on the complaint by his wife. While charges under Section 376 (punishment for rape) were deemed to be “erroneous and illegal”, the court upheld the charges under Section 377 (unnatural offences) and Section 498A (relating to cruelty to women) against the husband.

Justice N K Chandravanshi relied upon an exception under Section 375 of the IPC, which states that “sexual intercourse or sexual act by a man with his own wife, the wife not being under fifteen years of age, is not rape.” The judge, hence, noted, “in this case, complainant is legally wedded wife of applicant No. 1, therefore, sexual intercourse or any sexual act with her by the applicant No. 1/husband would not constitute an offence of rape, even if it was by force or against her wish.”

Justice N K Chandravanshi relied upon an exception under Section 375 of the IPC, which states that “sexual intercourse or sexual act by a man with his own wife, the wife not being under fifteen years of age, is not rape.” The judge, hence, noted, “in this case, complainant is legally wedded wife of applicant No. 1, therefore, sexual intercourse or any sexual act with her by the applicant No. 1/husband would not constitute an offence of rape, even if it was by force or against her wish.”

The wife’s complaint alleges that she was subjected to cruelty, abuse and dowry harassment days after her marriage. She has also alleged that her husband had unnatural physical relations with her, and despite her protests, inserted his fingers and a radish in her vagina.

Taking note of the allegations of cruelty, which have been supported by her parents and “neighbouring witnesses”, the judge held, “I do not find any infirmity in framing charges under Section 498-A/34 of the IPC against the applicants.”

The court also sustained the charges under Section 377, while observing that “where dominant intention of the offender is to derive unnatural sexual satisfaction, repeatedly insert any object in the sex organ of the victim and consequently derives sexual pleasure, such act would constitute as a carnal intercourse against the order of nature.”

A video has come to light purportedly showing brothers Rahul Kala and Naveen Bali, associates of jailed gangster Neeraj Bawana, sitting inside a lock-up and enjoying liquor and snacks. The two were in Mandoli Jail before they were re-arrested on August 5 in connection with a separate case, and were taken on police remand by the Special Cell till August 10, before returning to jail.

Police did not confirm whether the video is from the Special Cell office or Mandoli jail.

The 24-second video purportedly shows four men sitting inside the police lock-up with Rahul and Naveen and consuming liquor, chips and other food items. The men are seen sitting on a mattress, and also seen talking on the phone and smoking. Two persons can purportedly be seen sitting outside the lock-up.

When contacted, DG (Tihar jail) Sandeep Goel said, “We will look into it.”

Delhi Police spokesperson, Chinmoy Biswal said, “The video is not substantiated and liquor is not served in police lock-up.”

Citing a media report, Delhi Chief Minister Arvind Kejriwal on Thursday said the national capital has surpassed mega cities like New York, London and Shanghai in terms of most number of CCTV cameras installed per square mile and congratulated the officers and engineers concerned for achieving the milestone.

Citing a Forbes India report on the most-surveilled cities of the world, which put Delhi on the top with 1,826.6 CCTV cameras per square mile, followed by London with 1,138, the chief minister tweeted: "Feel proud to say that Delhi beats cities like Shanghai, NY (New York) n London with most CCTV cameras per sq mile. Delhi has 1826 cameras, London has 1138 cameras per sq mile.

"My compliments to our officers and engineers who worked in mission mode n achieved it in such a short time."

Chennai secured the third place with 609.9 CCTV cameras and Mumbai occupied the 18th position with 157.4 CCTV cameras per square mile, the Forbes India report said.

In Delhi, CCTV cameras are being installed by the Public Works Department (PWD). The government is eyeing to install around 2.8 lakh CCTV cameras across the city in two phases.

According to PWD officials, over 1,05,000 CCTV cameras were installed in the city by December 2019.

Making a startling revelation in the Supreme Court, the Enforcement Directorate on Thursday said it has unearthed a “secret underground office” here which was being operated by erstwhile Unitech founder Ramesh Chandra and visited by his sons Sanjay Chandra and Ajay Chandra when on parole or bail.

ED, which has been investigating money laundering charges against the Chandras' and Unitech Ltd, said that both Sanjay and Ajay have rendered the entire judicial custody otiose as they have been freely communicating, instructing their officials and disposing of their properties from inside the jail.

A bench of Justice D Y Chandrachud and M R Shah was told by Additional Solicitor General Madhavi Divan, appearing for the ED, that Chandras' have deputed their officials outside the jail to communicate their instructions to outside world.

“During one of our search and seizure operations, we have unearthed a secret underground office, which is being used by Ramesh Chandra and visited by his sons when they are out on parole or bail.

"We have recovered hundreds of original sale deeds from that office, hundreds of digital signatures and several computers which contain sensitive data with regard to their properties in India and abroad,” Divan told the bench.

She said the probe agency has submitted two status reports in sealed cover to the court and have provisionally attached Unitech Ltd properties worth Rs 600 crore both in India and abroad.

Divan pointed out that the agency has found a very “intricate web of money trail” through shell companies and the properties are being disposed of in real time, which is creating problem in the probe.

“They (Chandras') have been operating from inside the jail premises. They have rendered the entire judicial custody otiose. They are freely communicating and passing on instructions with the help of people deputed outside the jail premises. ED has found that they have even tried to influence a “dummy director" when he was being interrogated by the agency”, Divan said.

Senior advocate Vikas Singh, appearing for the Chandras, said that nothing is done against the jail manual.

The top court said it is not hearing the Chandras at present and would first hear the ED's submission.

On June 4, the top court had granted 15-day interim bail to Sanjay Chandra to attend the last rites of his father-in-law after which he had surrendered.

On August 14 last year, the top court had dismissed the bail plea of Chandra, who was a month earlier granted interim bail for 30 days on "humanitarian grounds" as both his parents had tested positive for COVID-19, and asked him to surrender within three days.

The apex court had also dismissed the bail application of Chandra's brother Ajay Chandra, who is in jail since August 2017.

Both Sanjay and Ajay are accused of allegedly siphoning home buyers' money. The top court in its October 2017 order had asked them to deposit Rs 750 crore with the apex court registry by December 31, 2017.

The Chandras have claimed that they complied with the court's conditions and they have deposited an amount in excess of Rs 750 crore and therefore they are granted regular bail.

The top court had noted that since the October 2017 order, significant events have taken place and the apex court had directed a forensic audit to be conducted by Grant Thornton.

It said that the court had earlier directed the Centre to ensure that all aspects, which were adverted to in the forensic report, should be investigated by the competent agencies, including with regard to the aspect of money laundering.

The matter pertains to a criminal case which started initially by one complaint lodged in 2015 and later joined by 173 other home buyers of Unitech projects' -- 'Wild Flower Country' and 'Anthea Project' -- situated in Gurugram.

On January 20 last year, in a respite to over 11,000 hassled home buyers of Unitech, the top court had allowed the Centre to take total management control of the realty firm and appoint a new board of nominee directors.

The apex court had approved the name of retired Haryana cadre IAS officer Yudvir Singh Malik as chairman and managing director (CMD) of the new board and directed that the existing board of directors of the company would stand superseded.

In 2018, the top court had directed a forensic audit of Unitech Ltd and its sister concerns and subsidiaries by Samir Paranjpe, Partner, Forensic and Investigation Services in Grant Thornton India.

The forensic auditors had submitted their report which said that Unitech Ltd received around Rs 14,270 crore from 29,800 home buyers from 2006-2014 and around Rs 1,805 crore from six financial institutions for the construction of 74 projects.

Threats against the Indian-origin community in South Africa do exist after the recent violence, but the Government is doing everything in its power to counter it, Mahatma Gandhi’s granddaughter Ela Gandhi said on Monday.

Protests against the incarceration of former president Jacob Zuma on July 7 rapidly devolved into orgies of looting and arson in the two provinces of  KwaZulu-Natal and Gauteng.

Zuma has been sentenced for contempt of court after he repeatedly refused to testify at the Commission of Inquiry into State Capture, where several witnesses have implicated him in corruption.

Some media reports on the violence which wracked the provinces of KwaZulu-Natal and Gauteng last month said that Indian-origin South

Africans bore the brunt of the attack, some even stating that ‘many’ of the 330 people killed as looters went on the rampage were of Indian origin.

Bewakoof, a youth-focused direct-to-consumer brand, on Wednesday said it has raised Rs 60 crore in funding from InvestCorp, IvyCap and Spring Marketing Capital.

Bewakoof, which has raised a total funding of Rs 170 crore including this round, will utilise the fresh proceeds for scaling up the business, marketing and talent acquisition, a statement said.

The company is also on track to clock Rs 2,000 crore in sales by 2025, and plans to accelerate its growth trajectory by investing in areas like branding, technology and talent, it added.

Bewakoof, which recently rolled out celebrity-led digital campaigns with Rajkummar Rao, Sanya Malhotra and Farhan Akhtar, plans to further build by signing other A-list celebrities to launch high decibel marketing campaigns across digital, out-of-home (OOH) and TV.
On the technology side, the company intends to launch a gamification-led loyalty programme.

“Bewakoof has emerged as the largest D2C fashion brand in India, this growth has come on the back of rolling out new categories, exclusive fashion range with brands like Coca Cola. With the new fund raise, we are gearing to take the brand to an unexplored new customer base which will be enabled through mass media like TV and print campaigns,” Bewakoof founder and CEO Prabhkiran Singh said.

Direct-to-consumer (D2C) brands are companies that sell and ship their products directly to customers without relying on distributors or traditional retail channels.

The focus is to bring the best of fashion at the best of prices to customers who have shown unwavering support and are the reason that the brand stands apart in a crowded segment like fashion, he added.

Launched in 2012, Bewakoof offers products across apparel, footwear and mobile covers. It has recently expanded into the beauty segment with its ‘Cosmos’ brand. The company, which has served six million customers till date, is adding over 100,000 new customers every month.

The company is also planning to launch new categories like activewear and innerwear, in addition to scaling up Cosmos.

West Bengal Chief Minister Mamata Banerjee on Wednesday slammed the Centre over its National Monetisation Pipeline (NMP) policy, claiming that it is a ploy to sell assets that belong to the country and not to Prime Minister Narendra Modi or the BJP.

Terming the NMP as a "shocking and unfortunate decision", the Trinamool Congress supremo alleged that the money raised by selling those assets will be used during elections against opposition parties.

"We condemn this shocking and unfortunate decision. These assets belong to the country. It is the property of neither Modi nor the BJP. They (central government) can't just sell a country's assets as per their whims and fancies," Banerjee told reporters at the state secretariat Nabanna.

The entire country will stand together and oppose this "anti-people" decision, she said.

"The BJP should be ashamed. No one has given them the right to sell our nation's assets," she said.

Finance Minister Nirmala Sitharaman on Monday announced Rs 6 lakh crore National Monetisation Pipeline (NMP) that will look to unlock value in infrastructure assets across sectors ranging from power to road and railways.

The Supreme Court has been informed that a total of 151 cases are pending against sitting and former MPs/MLAs in special CBI courts across the country, and as many as 58 cases are punishable with life imprisonment. However, in nearly one-third of the cases, the trial is moving at snail’s pace – charges have not been framed, though offences were committed several years back.

Senior advocate Vijay Hansaria, appointed amicus curiae in a 2016 petition filed by advocate Ashwini Kumar Upadhyay seeking direction to fast-tracking of criminal trials against sitting and former MPs/MLAs, has filed the report in the top court. He has been assisted by advocate Sneha Kalita in the matter.

The fourteenth report, in the matter, said: “It may be noted that out of 151 cases pending trial before the Special Courts, CBI, as many as 58 cases are punishable with life imprisonment. In 45 cases, even the charges have not been framed, though the offences alleged to have been committed several years back.”

The CBI has furnished a status report dated August 19, to the amicus mentioning the details of the cases pending trial before different CBI courts and those under investigation. The CBI cases pending investigation against MPs/MLAs are 37.

The oldest pending case is in Patna, where the accused was charge-sheeted on June 12, 2000. The report highlighted inordinate delay in several cases pending trial before CBI courts in different parts of the country.

According to the Enforcement Directorate’s status report, a total number of 51 Members of Parliament, both sitting and former, are accused in cases arising out of offences under Prevention of Money Laundering Act, 2002. However, the report does not show as to how many MPs/MLAs are sitting and/or former legislators.

The report suggested that courts before whom the trials are pending may be directed to expedite the trial of all pending cases on day-to-day basis in terms of Section 309 of the CrPC.

“All the High Courts may be directed to issue administrative instructions to the effect that the concerned courts dealing with cases investigated by the CBI and the Enforcement Directorate shall deal with the cases pending before MPs/MLAs on priority basis and other cases shall be dealt only after the trial in these cases are over,” said the report.

The amicus suggested in case, additional courts are required, the high courts and the appropriate government shall constitute additional special courts.

The report further suggested that cases where investigations are pending before the ED and the CBI, a monitoring committee may be constituted comprising of the following: former judge of the top court or the former Chief Justice of a high court, the Director, ED (or his nominee not below the rank of Additional Director), the Director, CBI (or his nominee not below the rank of Additional Director), the Union Home Secretary (or his nominee not below the rank of Joint Secretary), and a judicial officer not below the rank of district judge to be nominated by the top court.

Amicus suggested the committee may be constituted within a period of two weeks of the order and it should furnish its status report regarding each particular case in a sealed cover to the top court within two months of its first sitting.

On August 10, the top court gave last opportunity to the Centre to submit a detailed status report regarding details of pendency and stage of trial of cases involving sitting and former lawmakers registered with the central agencies, CBI, and others.

A bench headed by Chief Justice N.V. Ramana and comprising Justices Vineet Saran and Surya Kant had told Solicitor General Tushar Mehta: “We are reading these reports in newspapers. They don’t send us anything. We get everything in the evening; we don’t know anything”.

The CJI said in September last year, the court had granted time to Centre to file a detailed status report, then in October, again time was sought, and today, the situation is the same.

This does not work, he noted. “What else can we say to express our displeasure, we were told Centre is concerned about pending cases against MPs/MLAs”, he had added.

A day after Union Finance Minister Nirmala Sitharaman unveiled the government’s four-year National Monetisation Pipeline (NMP) worth Rs 6 lakh crore, former Congress President Rahul Gandhi on Tuesday accused Prime Minister Narendra Modi of bringing the process of selling the “crown jewel” assets built by his party in last 70 years.

He also contended that the Congress is not opposing the privatisation process but “the entire NMP is designed to create a monopoly”.

Addressing a press conference at the party headquarters along with former Finance Minister P. Chidamabaram, Gandhi said: “The Prime Minister and the BJP said that the Congress had done nothing in last 70 years. There is a list here of all the assets that the Congress has helped build using the public money.”

Now the Prime Minister is in the process of selling the crown jewels of this country.”

Listing out the sectors which are going to be privatised, Gandhi said that these are being sold and one can guess to whom it is going.

“And frankly, these will go to three to four people,” he said.

Announcing the measure on Monday, Sitharaman had said it is to unlock value in brownfield projects by engaging the private sector, transferring to them the rights but not the ownership in projects, and using the funds for infrastructure creation across the country.

But assailing the government, Gandhi said: “I want to tell the youths, your employment has been snatched, for farmers, three special farm laws have been made. And today I want to say what Prime Minister plans to give to his industrialist friends.”

This, he claimed, comprises 26,700 km of national highways worth Rs 1.6 lakh crore, Rs 1.5 lakh crore in railways with 400 railways stations, 150 private trains, railway tracks and warehouses. He further said that 42,300 circuit km of transmission network, 6,000 MW power generation, solar wind assets from NHPC, NTPC and NLC, and 8,000 km of national gas pipeline of GAIL are all going to be privatised.

Even the 4,000 km of petroleum pipeline, 2.8 lakh km of telecom assets of Bharat Net Fibre Netowrk, BSNL and MTNL towers, warehouses worth Rs 29,000 crore with a stroage space of 210 lakh metric tonne, 107 coal mines, 761 mineral blocks, 25 airports worth Rs 21,000 crore, ports worth Rs 13,000 crore along with 31 projects, and two national stadium worth Rs 11,000 are going to be gifted to few industrialists, he said.

Reiterating that these are going to be given to “only three to four people”, Gandhi said: “This is your future. Your future is being sold to these three four industrialists. It is reality.”

He, however, said that Congress is not against privatisation.

“We had logic behind privatisation,” he said, adding that the industries, which were chronically loss-making and the companies with minimal market share were privatised.

“And the sectors where there were risk of private sector monopoly, we decided not to sell. But this entire scheme is designed to create monopoly,” he alleged.

“All the sectors that I have named are there to bring monopoly. We say do privatisation but not at the cost of loss to the country,” he said, claiming that when these assets are privatised or sold to private players, then there will be very few employment opportunities.

“I had warned about Covid and you all made fun of me. When this starts your chances of getting employment will be less. The assets of India are being sold and it is an attack on your future,” he said, adding that the Prime Minister is not working for India but “for three or four people”.

On August 15, the public sector aircraft manufacturing company Hindustan Aeronautics Limited (HAL) carried out a successful ground run and low speed taxi trials of a commercial aircraft – Hindustan-228 – for ‘Type Certification’ by the Directorate General of Civil Aviation (DGCA).

The 19-seater Hindustan-228 or the Do-228 is the first major attempt in India to develop a small civil transport aircraft after the 14-seater Saras aircraft development program at the National Aeronautics Laboratory was shelved in 2009 on account of multiple problems in its development.

The type certification by the DGCA will enable HAL to get an international certification for the aircraft. The aircraft complies with airworthiness requirements prescribed by the US Federal Aviation Authority for ‘normal, utility, acrobatic and commuter’ planes, HAL has stated.

Small civilian aircrafts are considered to be an essential element of the UDAN (Ude Desh ka Aam Naagrik) scheme that the central government is attempting to put in place for regional connectivity.

Union civil aviation Minister Jyotiraditya Scindia said recently that the central government aims to set up 1,000 new air routes and establish 100 new airports, under the UDAN scheme. “Two civil demonstrators of Do-228 have already been made and are ready to be deployed in the North East and Uttar Pradesh, the two places where we want to start the UDAN scheme,” HAL Chairman R Madhavan said this week on the sidelines of a company CSR event. This Hindustan-228 can be utilized by civil operators and state governments for intra and inter-state connectivity with training, maintenance and logistics support from HAL.

Is the Hindustan-228 a spin off from any other aircraft?

The Hindustan-228 aircraft is built on the existing frame of the German Dornier 228 defence transport aircraft used by the defence forces. In February 2020, HAL received the modification document for the HAL Do-228 upgraded civil aircraft from DGCA at the DefExpo in Lucknow. Two civil Do-228 produced by HAL for launch under UDAN scheme have a maximum take off weight of 6200 kgs. In order for the transport aircraft to be flyable under Commercial Pilot License category HAL has to reduce the aircraft weight below 5700 Kgs.

HAL Do-228-201(Upgraded) civil aircraft is equipped with a digital cockpit which will ensure more accurate readings, precise information and ergonomic data displays with feedback loops and capability for self-check to alert pilots in emergencies.

What is the status of the development of the Hindustan 228?

The Do-228 fulfilled the requirement of a Light Transport Aircraft (LTA) within the defence forces.

HAL has produced a total of 125 Dornier 228 under license at Kanpur since 1983. On December 26, 2017 the DGCA cleared HAL Do-228 to be used for civilian flights.

HAL’s transport aircraft division at Kanpur is now manufacturing the Hindustan-228 aircraft to support the Regional Connectivity Scheme (UDAN) of the Government of India. On May 27, the first ground run of the first prototype of the aircraft was carried out. On August 15 ground trials and low speed taxi trials of the aircraft were carried out for type certification by the DGCA. HAL chairman R Madhavan told  that HAL is now looking at international certification. “ The international certification has been taken up parallely. DGCA is onboard with us. We will go for a high speed trial very soon and will certify the aircraft. Once this is done it becomes more usable,” the chairman said.

What are the roles envisaged for the civilian Hindustan 228 aircraft?

The Hindustan-228 is conceived to be a multirole utility aircraft capable of being used for VIP transport, passenger transport, air ambulance, flight inspection roles, cloud seeding, recreational activities like para jumping, aerial surveillance, photography, remote sensing and cargo transport. With a maximum cruise speed of 428 kmph and a range of 700 kmph, the aircraft is capable of night flying. HAL is looking forward to exporting the aircraft as well to countries like Nepal.

What is the status of the Saras civilian aircraft project taken up in India in the 1990s?

The National Aerospace Laboratories (NAL) was asked by the GoI in 2017 to revive development of its 14-seater Saras Mk2 aircraft under the UDAN scheme – after the project was halted in 2009 following a major crash which killed three test pilots. The second prototype of the Saras had flown 45 times and had even been presented at Aero India 2009 – a few days before it crashed.

The project was revived after analysis of the accident revealed the crash was a result of procedural lapses and not due to technical issues. The Saras – a 14-seater twin turboprop aircraft aimed at serving the maturing civil aviation market in India was initiated in the 1990s but was constantly plagued by controversies. The first prototype of the Saras which flew on May 29, 2004 was nearly 993 kg over weight on a proposed 4125 kg. The aircraft flew nearly 125 flights. Subsequently, an engine change cut the weight in the second prototype. But the aircraft crashed on March 6, 2009. A third prototype that was closer to the 4125 kg mark was in the pipeline in 2009 when the crash occurred.

The Saras program has received fresh impetus under the Make in India and UDAN programs of the NDA government. The development of Saras is projected as a precursor to the development of a proposed 70 seater Regional Transport Aircraft involving NAL and HAL that was initiated in 2013 but was subsequently shelved with HAL focussing on modifying the Dornier 228 aircraft for the civil aviation market in India.
